Terms of service

Please read these Terms of Service ("Terms") carefully. They form a binding agreement between you and Printing Uncle ("Printing Uncle", "we", "us", "our").

1. Acceptance of These Terms

By using our website, requesting a quote, uploading a design, placing an order, or otherwise engaging our services, you agree to be legally bound by these Terms. If you do not agree, do not place an order. These Terms apply to all past, present and future dealings between you and Printing Uncle, whether the order is placed through our website, by email, by phone, or in person.

We may update these Terms at any time. Material changes will be posted on this page with a revised "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the revised Terms.

2. Eligibility and Accounts

Our services are available to individuals aged 14 and over. Customers under the age of majority in their province must have the authorization of a parent or legal guardian to place an order. If you order on behalf of a company or organization, you confirm you are authorized to bind that entity.

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Account information you provide must be accurate and current.

3. Quotes

Quotes issued by Printing Uncle are valid for 14 days from the date of issue. After that period, prices are subject to change without notice. Quotes are based on the quantities, garments, print sizes and print locations specified at the time of quoting; any change to those specifications will change the price.

4. Artwork and Designs — Proofs

Your proof is the design you build and approve in our design studio. The studio shows your artwork on the actual garment, in the colour and size you selected, before you add it to the cart. What you approve on that screen is what goes to production. We do not issue a separate proof by email after ordering unless one has been expressly agreed in writing for your order.

Where we build the artwork for you — because you asked us to, or because you ordered by phone or email — we will send you an image to approve before production, and your written approval of that image is your proof.

You are solely responsible for reviewing your design before approving it, including spelling, artwork placement, sizing, colours, image resolution and file quality.

If an error exists in the artwork you submitted or approved, that error will be reproduced on the finished goods and the resulting cost is yours. Printing Uncle is not liable for reprints, refunds or credits arising from customer-side artwork errors.

Low-resolution or non print-ready files may cause delays or a reduction in print quality. We may, but are not obliged to, contact you about a file we consider unsuitable for printing.

5. Quantities and Underruns

Manufacturing variances are normal in apparel decoration. An underrun of up to 3% is considered acceptable and constitutes complete fulfillment of your order. For example, an order of 100 shirts delivered as 97 shirts is a fully performed order. Where an underrun occurs, you will be charged only for the pieces actually delivered.

6. Payment

Full payment is required before production begins. No order enters production until payment has cleared in full.

Production turnaround times begin only once (a) payment has cleared, and (b) all required materials, artwork, sizes, colours and instructions have been received. Production times quoted are estimates, not guarantees.

7. Cancellations

If you cancel an order after production has begun, you remain responsible for the full cost of all work completed and all materials purchased or committed to your order up to the point of cancellation, including garments, ink, film and any setup already performed. Any balance remaining after those costs will be refunded as store credit.

8. Inactive Orders and Storage

If an order cannot proceed because we are waiting on you — for artwork, approvals, sizing, payment or instructions — and remains inactive for 90 days, we may cancel it. In that event, any refund is limited to goods that have not yet been produced, and will be issued as store credit only.

Finished goods held at our facility for more than 30 days after completion are subject to storage fees. Goods left unclaimed beyond 90 days may be treated as abandoned property and disposed of at our discretion, with no refund owing.

9. Colour and Garment Variations

Colour reproduction in custom apparel decoration is not an exact science.

• We do not guarantee exact Pantone, CMYK or RGB colour matching, either between printing methods or across different garment types, fabrics or colours.
• Colours displayed on your screen are approximations only and will vary between monitors, phones and browsers.
• A reasonable variation in colour between the on-screen design, any mockup, and the finished product is considered acceptable and is not grounds for a claim.
• Garments are produced by third-party manufacturers. Variations in dye lots, sizing, garment weight, fabric and construction are outside our control, and Printing Uncle accepts no liability for them.
• Product availability changes without notice. Where a garment, colour or size becomes unavailable, we may substitute the closest available equivalent or refund the affected items as store credit.

10. Delivery, Shipping and Risk

Title to the goods and all risk of loss pass to you at the moment the goods are handed to the carrier. From that point onward, the shipment is your responsibility.

Printing Uncle accepts no liability for late delivery, lost packages, misdelivery, theft, or goods damaged in transit. Delivery dates provided by us or by any carrier are estimates only and are not guaranteed. Where shipping insurance is available and purchased, claims are made through the carrier.

11. Inspection and Claims

You must inspect your order promptly on receipt. Any claim relating to defects, misprints, shortages, incorrect items or quality must be submitted in writing to Meet@printinguncle.com within 5 business days of delivery.

Claims received after that window will not be accepted and no reprint, refund or credit will be issued. Where a claim is accepted, our sole obligation is, at our option, to reprint the affected items or to issue a credit for them. Defective goods must be returned to us on request before a remedy is provided. Custom-printed goods are not otherwise returnable or refundable.

12. Intellectual Property in Your Artwork

You retain ownership of the copyright in the artwork you submit.

By submitting artwork to us, you grant Printing Uncle a worldwide, non-exclusive, royalty-free licence to reproduce, modify (for production purposes), store and display that artwork as required to fulfill your order, and to display images of the finished product in our portfolio, catalogue, website, social media and marketing materials, including in thumbnail or cropped form, and to share it with production partners and service providers acting on our behalf. If you do not want your work shown publicly, tell us in writing at the time of ordering and we will exclude it.

You warrant that you own or hold all rights, licences and permissions necessary for the artwork you submit, including any trademarks, logos, photographs, characters, fonts and names contained in it.

You agree to indemnify, defend and hold harmless Printing Uncle from and against any claim, demand, action, loss, damage, penalty or expense — including legal fees and costs — arising from an allegation that artwork or instructions you supplied infringe the intellectual property, publicity or other rights of any third party.

We may refuse or cancel any order we believe infringes third-party rights, and we may report and terminate the accounts of repeat infringers.

13. Our Intellectual Property

"Printing Uncle", printinguncle.com, our logo, graphics, site content and design tools are the property of Printing Uncle and may not be used, copied or reproduced without our prior written consent.

14. Prohibited Content and Conduct

You may not use our services to produce or transmit content that is unlawful, hateful, harassing, defamatory, obscene, that infringes third-party rights, that impersonates another person or entity, or that violates any applicable law. You may not access our site by automated means without our permission, or use it to send spam or unsolicited solicitations. We may refuse any order at our sole discretion.

15. Warranty Disclaimer

Our website, design tools and services are provided on an "AS IS, AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or secure, and we may suspend, modify or restrict access to it at any time without notice.

Nothing in this section removes any statutory right you have that cannot be excluded under Ontario or Canadian law.

16. Limitation of Liability

To the fullest extent permitted by law:

• Printing Uncle is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost sales, lost business, missed events or missed deadlines, whether or not we were advised such damages were possible.
• Our total aggregate liability for any claim shall not exceed the total amount actually paid by you for the specific order giving rise to the claim.
• Claims must be brought on an individual basis only. Class actions, class arbitrations and representative proceedings are not permitted.

Your statutory rights under the Ontario Consumer Protection Act, the Sale of Goods Act and other applicable Canadian law are not affected by this section.

17. Indemnity and Release

You release Printing Uncle from all claims arising out of your use of our services, and you agree to indemnify us against any claim arising from your breach of these Terms, your use of the services, the artwork or instructions you supply, your sale or distribution of the goods we produce for you, or any misrepresentation as to your ownership of intellectual property.

18. Force Majeure

Neither party is liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, pandemics, epidemics, natural disasters, fire, flood, war, civil unrest, government orders, labour disputes or strikes, supplier or blank-garment shortages, carrier and shipping disruptions, utility outages, and equipment or machinery failure.

The affected party will give notice as soon as reasonably possible. If the event continues for more than 90 days, either party may terminate the affected order, with payment owing only for work already completed.

19. Termination

We may suspend or terminate your account or refuse service at any time, without notice, for any reason, including breach of these Terms. You may stop using our services at any time. Sections relating to artwork licences, indemnity, disclaimers, limitation of liability, governing law and this section survive termination. You are responsible for retaining copies of your own artwork; content stored in your account may be deleted following termination.

20. Third-Party Links

Our site may link to third-party websites or resources. We do not control them, do not endorse them, and accept no responsibility or liability for their content, products or practices.

21. Electronic Communications

By providing your email address or phone number, you consent to receive transactional communications from us relating to your quotes, orders, production status and delivery. Marketing communications are optional and you may unsubscribe at any time using the link in any marketing email or by writing to Meet@printinguncle.com. You agree that electronic communications satisfy any legal requirement that a communication be in writing.

22. Privacy and Personal Information

Printing Uncle handles personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. Please see our Privacy Policy for full details.

Information you provide is collected and used to process, produce, ship and support your order, and may be shared with couriers, payment processors, garment suppliers and other service providers acting on our behalf, including service providers located outside Canada, where it may be subject to the laws of that jurisdiction.

We do not sell your personal information to third parties. You may request access to, correction of, or deletion of your personal information by writing to Meet@printinguncle.com, subject to our legal and accounting record-keeping obligations.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. You agree that any dispute will be resolved exclusively in the courts of the Province of Ontario, and you submit to the jurisdiction of those courts.

24. General

Entire agreement. These Terms, together with our Privacy Policy and any written order confirmation or quote, constitute the entire agreement between us and supersede all prior discussions. Where a signed, order-specific agreement conflicts with these Terms, the order-specific terms prevail for that order.

Severability. If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of it or of any other breach. Waivers are effective only if made in writing.

Assignment. We may assign these Terms. You may not assign them without our written consent.

Interpretation. Headings are for convenience only. These Terms will not be construed against the drafter. In the event of a translation, the English version governs.

Statutory rights. Nothing in these Terms excludes any right that cannot lawfully be excluded under Ontario or Canadian law.
